Senator representing the Kogi West Senatorial zone, Dino Melaye, is yet to be let off the hook as an Abuja division of the Federal High Court dismissed his applicationseeking to nullify his recall.
In its ruling today, Monday, the court, presided by Justice Nnamdi Dimgba said that contrary to the arguments of Senator Melaye that he was not granted fair hearing, the constitution does not require a special provision that mandates INEC to grant the senator an opportunity of fair hearing.
The court ruled that INEC provides Senator Melaye with the recall petition, schedule of signatures attached to the petitions and a full list of persons in support of the recall process, within two weeks before an amended time table for the recall would be made.
Senator Melaye had approached the court seeking to stop the process of his recall by people in his constituency, leading to the court ordering INEC to halt the process of the recall exercise pending the determination of his application. [myad]
