You Can’t Sack Elected Councilors, Court Over-Rules Plateau Governor‎

A Jos High Court has ruled that Governor Simon Lalong of Plateau State has no powers to dissolve elected Local Government Councilors in the State.

The Court also set aside the Local Government Law, which the Governor relied upon to remove the democratically elected Council officials.

In his judgment, Justice David Mann said that section 41, sub section 4 of 2007 Local Government Laws of the State, which empowered the Governor to dissolve the Council officials, was at variance with section 7 of the 1999 constitution as amended and therefore null and void.

It would be recalled that Governor Lalong had in 2015, after taking the mantle of leadership in the State, dissolved the democratically elected Local Government Chairmen and Councilors in the State.

The aggrieved Council officials who had approached the court to seek redress insisted that the action of the Governor was illegal as their tenure had not been completed.

The sacked Councilors who had mobilized to the court in large numbers were, however, disappointed when the court ruled against their reinstatement.

According to the Judge, the 2007 Local Government Laws which was amended in 2008 only stipulates, a two year tenure for the Councilors, adding that since the Councilors were elected in 2014, their two year tenure ought to have expired in 2016.

Speaking to news men after the judgment, Counsel to the plaintiff, Gyang ZI, said: “although there was no consequential order by the court o reinstate the ousted councilors, my clients have been vindicated by the court’s pronouncement declaring the action of the Governor as illegal.”

On his part, Counsel to Governor Lalong and three others joined in the suite, Nanle Kumak, said they will abide by the court’s judgment. [myad]

There are good reasons why Nigerians should take more than a passing interest in the controversy generated by the actions of members of the Senate Committee on Customs, Excise and Tariffs and that of the Nigeria Ports Authority. If the reports in the media are true, the matter goes beyond the victimisation of one organ of government by another. It is a possibility that members of the National Assembly might be on a mission to crash the federal governments’ war against corruption using the power of ‘oversight’ as cover. Two recent incidents would serve to illustrate the danger.
Sometime in October/November, 2016, a rice trading company, Master Energy Commodities Trading Ltd, imported into Nigeria, 1,200 metric tons of rice in thirty, 40-foot containers. In their attempt to evade paying the correct custom duties, they declared the ‘rice’ consignment as ‘yeast’. The goods were later intercepted and seized on the orders of the Controller-General of customs CGC, Col. Hamid Ali (rtd). Unfortunately, this seemingly patriotic action by a public officer was seen as an affront to one senior member of the National Assembly. A Senator, the leader of the Senate Committee on Customs, Excise & Tariff, wrote the CGC demanding that the consignment be released forthwith, on the dubious claim that he had investigated the matter and had found the importer blameless. His findings? That it was the clearing Agent not the importer that called the goods ‘yeast’ instead of ‘rice’!
The CGC brushed aside this incredible story; as any right thinking person would do. But to the shock of all Nigerians, all hell broke loose. The Senate Committee then summoned him to appear before them in uniform- seeing that as a retired army colonel, the CGC had refrained from wearing the customs uniform. He was also directed to answer a long list of queries by this same angry panel. In the end, he was dragged before the Senate at plenary, put through a cruel inquisition, publicly humiliated and dismissed as ‘not fit to hold public office’.
Fast-forward to last week. This time, a dubious scheme was uncovered in which a subsidiary company of the Nigerian Ports Authority, NPA, went into a joint venture with a private company to manage the Calabar Port. Both the NPA subsidiary, called Calabar Channel Management, CCM and the private company, Niger Global Engineering & Technical Co. Ltd, were incorporated together in 2014, just for this deal. The purported JV partner was then awarded a contract to dredge the Calabar Channel; a contract the Bureau of Public Procurement was to condemn as violating all due processes. This did not discourage them from demanding and getting a whopping 12.5million dollars upfront payment from the NPA or asking for a purported balance of 22million dollars.
In the meantime, a rash of petitions and reports had inundated the NPA against this contract, with many alleging it to be a bogus scam to siphon public funds. The Bureau of Public Procurement was the first to cry out, saying both the award of the dredging contract and the initial payment of over N4billion to Messrs Niger Global Engineering & Technical Co. Ltd, were done in violation of the law. Even worse, all efforts of the new management of the NPA under Ms. Hadiza Bala Usman, to find evidence of the dredging work purported to have been done in the Calabar Channel at the time the company claimed to have done so, was unsuccessful.
That is not all. There was also the report by a consultant that advised against a joint venture partnership for the purpose of managing the Calabar port. Their reason was simply that maritime activities in the Calabar port was too low, that a joint venture scheme as obtained in Lagos and Bony was unsustainable.
Faced with these negative outcomes, the NPA management under Ms. Bala Usman decided that national interest would be better served if the JV scheme as well as the so-called dredging project are terminated. On their part, the Economic and Financial Crimes Commission, EFCC, have moved in, with a mission to “recover public funds collected for job not done”.
Now, the name of the person driving this scheme is quite instructive going by the very loud and sustained counter attacks being mounted against the public officers; officers that insist that right things are done. He is the leader of the Senate Committee on Customs, Excise and Tariff. He is the owner of both the Niger Global & Engineering Co. Technical Ltd; as well as the rice smuggling giant, Master Energy Commodities Trading Ltd.
Nigerians must not leave the likes of Hamid Ali, Ibrahim Magu, Hadiza Bala Usman,(former BPP DG) Emeka Nzeh et al at the mercy of these strange law makers; politicians that have demonstrated time and again that they are in politics to serve themselves and themselves alone.
The experience of Hadiza Bala Usman, the new M.D of the NPA, is particularly sad. The more she tries to fight, to reduce graft and perfidy, the more determined they seem to mobilise against her, to neutralise her and see her back. They want her out because, they now claim, she is ‘too young’ to manage a complex organisation such as NPA – even though she is past 40 years of age. Unashamed, they question the wisdom of appointing a woman to such a post – her training and experience counting for nothing; apparently.
Incidents such as these are the reason the Nigerian public feels let down by our Parliament. They are the reason why a whole lot of Nigerians take a dim view of members of the National Assembly. Some even believe the conduct of our legislators is a major factor holding Nigeria down; why it is a laughing stock among the nations of the world.
It is the duty of all Nigerians to demand correct conduct from all public officials, including from members of the National Assembly; especially the Senate. Senator Bukola Saraki, the Senate President, must enforce discipline among his colleagues. No member of a committee, much less a chairman, should remain in his duty post once credible information about possible crime is received on the person. We need not remind our political leaders, most of all our legislators, that punishment always follow excess.

Justice Biobele Heads 7-Man Probe Team On Alleged Rights Abuses Against Army

Justice Biobele A. Georgewill, of the Court of Appeal has been appointed by Acting President Yemi Osinbajo to head a 7-man judicial commission of enquiry to look into the alleged right abuses preferred against officers of the Nigerian Army fighting Boko Haram insurgents in the North East.

The judicial commission, according to a statement today, Friday, by the senior special assistant to Acting President on media and publicity, Laolu Akande, is expected to review compliance of the Nigerian Armed Forces with human rights obligations and rules of engagement, especially in local conflict and insurgency situations.”

Laolu Akande said that the presidential committee is empowered to review extant rules of engagement applicable in the Nigerian Armed Forces, and the extent of compliance thereto.

“It is also empowered to investigate alleged acts of violation, (by Nigerian security agencies) of international humanitarian and human rights law under the Constitution of the Federal Republic of Nigeria, 1999 (as amended), Geneva Conventions Act, African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act and other relevant laws.

“The commission equally has a mandate to investigate factors that might be militating against a speedy resolution of local conflicts and insurgencies and also advise on means of preventing violations of international humanitarian and human rights law in conflict situations.”

Other members of the judicial commission, the statement said, are Major General Patrick Akem, Wale Fapohunda, Hauwa Ibrahim, Jibrin Ibrahim, Ifeoma Nwakama, and a representative of the Office of the National Security Adviser (NSA).

The statement said that the commission is expected to commence work immediately and submit its report within 90 days.[myad]

All Progressives Congress (APC) in North Central has endorsed what it called matured leadership displayed by the National Chairman of the party, Chief John Odigie-Oyegun.

The party leaders in the region, who met under the auspices of the North Central Political Leaders Forum (NCPLF) in Ilorin, commended Oyegun for playing a leading role in the country’s democratic development.

They said that the leadership of the APC chairman had succeeded in pushing the Peoples Democratic Party (PDP) to near-irrelevancy and inspiring the grassroots.

“The APC National Chairman is building the party and acting responsibly. We are with the National Working Committee of the APC. We support Chief John Odigie-Oyegun.”

The North Central leaders of the party described Oyegun as “a focused leader with a tactical mind.”

 In a statement signed by NCPLF Chairman, Alhaji Mustapha Adisa, the leaders said that the national chairman had also succeed in bringing a different leadership perspective by offering purposeful leadership, motivating Nigerians to vote along the lines of policies and party politics and filtering out distractions.

They also praised Oyegun, who was once a governor of Edo State, for promoting the party’s interest in all fronts, running effective meetings and building consensus, despite sometimes strong differences of opinions and perspectives.

“We are grateful to Oyegun for putting forward a positive agenda for the unity and expansion of APC. We are grateful to our national chairman for attracting enough support for our great party.

A former Governor of Anambra State, Chief Chukwuemeka Ezeife, has said that Nigeria might be heading towards extinction if the country is not urgently restructured.

“Every honest Nigerian knows we are at the brink of extinction. Nigeria will cease to exist if we do not restructure. It is a joke for people to think we should not restructure.

Ezeife, who spoke today, Friday, in Benin city, Edo state capital at the 20th Professor Wole Soyinka annual lecture series organized by the National Association of Seadogs, insisted that only restructuring would free Nigeria from the plot by the British government to keep the country underdeveloped.

He called on Acting President Yemi Osinbajo to convoke a conference that would discuss the country.

“Osibanjo should make sure the issue of restructuring is complete by the middle of 2018. Make sure the zones control their security. We need to go back to the agreed Nigeria. Make the six zones federating units. Allow states in the zones to develop their own constitution.”

Senate Hunts For CEOs Of Glo Mobile, 29 Others Over Alleged N30 Trillion Revenue Scam

Senate-NigThe Senate has directed the Police to hunt for and arrest the Chief Executives of the Glo Mobile, British American Tobacco, CCECC, Dana Group, Olam Int. Ltd., Hong Xing Steel Co. Ltd, Visafone, African Wire, Star Comments and Allied Ltd. and Aarti Steel Nig. Ltd and Crown Flour Mills over their involved in the N30 trillion-revenue believed to have been lost by the country in its maritime sector.

Also declared wanted by the Senate in connection to the same alleged scam are Abyem-Diva Int. Ltd., Gagasel Int., Friesland Capina, Etco Nig., Edic Chemicals and Allied Distributors, De United Foods, Don Climax Group, Skill G Nig. Ltd., Premium Seafood and La Rauf Nig. Ltd.

Others are Standard Metallurgical Co. Ltd., Kam Industries, IBG Investment Ltd., Orazulike Trading Co. Ltd., Popular Foods Ltd., A-Kelnal Integrated & Logistics Services, African Industries, African Tiles & Ceramics and ZTE Nigeria.

The Senate Joint Committee on Customs, Excise and Tariff and Marine Transport, handling the investigation had invited 63 firms accused of complicity in the scam but only 33 honoured the invitation.

The order to arrest the companies’ officials was announced by Chairman of the committee, Senator Hope Uzodinma, at the committee’s meeting in Abuja today, Friday.

He said that the refusal of the officials to honour the invitation in spite of several reminders was disrespect for the National Assembly.

Uzodinma warned that the 8th Senate would not tolerate such behaviour from anybody or institution, particularly in the present situation that involved Federal Government funds.

According to him, investigations carried out by the joint committee showed several forms of infractions that have cost the country huge amount of money in revenue loss.

He said such development in a country currently in recession was a disservice to it.

”It is no longer going to be business as usual. We have directed the Nigeria Police to arrest the heads of the firms and bring them before us.

”If we can suspend our recess as lawmakers to see to the end of this investigation, I see no reason why the firms that have been indicted will not come to defend themselves.”

The chairman asked the firms that honoured the invitation to go through the documents given to them and return next week for defence.

The Senate had mandated the joint committee to carry out extensive investigation into alleged N30 trillion revenue leakages in the import and export value chain between 2006 and 2017.

The committee had already interfaced with commercial banks indicted in the matter as well as relevant government agencies.

Some Ugandan Women Complain Of Wounds On Their Breasts Through Sucking By Husbands

A top official of the Ugandan Ministry of Health, Samalie Namukose has narrated how many women she discovered to have wounds on their breasts complained that such wounds were caused by their husbands who often suck the breasts.
Namukose said: “in some health facilities I visited, many women had wounds on their breasts and when I asked what caused them, they said the men demand for breasts and cause those wounds. This is very serious and must stop.”
Namukose, who is principal nutritionist at the ministry, said that she was shocked to learn that some cultures believe that the breasts belong to men and therefore do not give babies the chance to enjoy breastfeeding.
She said that despite the fact exclusive breastfeeding is essential for babies in the first six months, many men are often uncomfortable with it and compete with the babies for the breasts.
Namukose spoke during a meeting for cultural leaders organised by the Ministry of Health in commemoration of the World Breastfeeding week marked annually between August 1 and 7.

Aisha Buhari visits Imo, Asks Women To Take Front Seat In Quest For National Unity

Aisha, Wife of President Muhammadu Buhari, just back from London, was in Owerri, the Imo State capital yesterday, Thursday, to drum up the necessity for women to be in the forefront of the quest for national unity.
Aisha Buhari, who attended a meeting of Imo women, convened by the wife of the state governor, Mrs. Nneoma Nkechi Rochas Okorocha at Heroes Square, Owerri, said the theme of the meeting – role of women in building bridges of friendship across the Niger – displayed the level of maturity, worth and resourcefulness that women have attained.
The President’s wife said that the occasion provided an opportunity for women to come together to socialize, dialogue and to work for unity among communities.
She called on Mrs. Okorocha to continue with this effort, even as she assured of her support, especially in areas that have to do with women, children and the underprivileged as she has been doing through the Future Assured Programme.
She thanked the state Governor, Owelle Anayo Rochas Okorocha for the support he is giving to his wife and called on other governors to emulate him in this regard.
In her address, Mrs. Nneoma Okorocha, called on women to build and fortify bridges of friendship because as she said, friendship is a gateway to love, unity, tolerance and mutual understanding, which every society needs for survival and development.
She said that the Nigeria is passing through a moment which calls for intensification of the bridge building.
She commended Aisha Buhari for being a star in national bridge building efforts through her Future Assured Programme and for laying the foundation of the Southern and Northern Governors Wives Fora, which today are building bridges of unity in the country.
She praised women for their role as mothers, wives, peacemakers, care givers, home builders and bridge builders and called on them to use this power to bring unity to the country.
The governor of Imo state, Owelle Rochas Okorocha said that Nigeria, although already a great country, must strive to be better.
He said that the movement to make Nigeria a greater country through the promotion of unity and peaceful coexistence is already a reality and Imo state is part of that movement.

Archbishop of Canterbury, Justin Welby, has said that the recovery of President Muhammadu Buhari from health challenges in London is a testimony to the healing powers of God and answer to prayers of millions of people round the world.
The Archbishop of Canterbury, who paid a personal visit to the President today, Friday at Abuja House in London, offered to continue praying for both President Buhari and Nigeria.
This was even as President Buhari expressed deep appreciation for the visit of Archbishop Welby, acknowledging that he had always stood by him at critical times.
The President wished him God’s continued grace in his spiritual duty of leading the Anglican Communion worldwide.
Special adviser to the President on media and publicity, Femi Adesina who issued a statement in respect of the visit, recalled the good relationship that had built between the Archbishop and Buhari.
He said that such relationship began at the time the former British Prime Minister, David Cameron described Nigeria as a “fantastically corrupt” country ahead of an anti-corruption summit in London in 2016 and Archbishop Welby responded by saying: “But this particular President (Buhari) is actually not corrupt.”
Adesina said that the Archbishop later personally received the Nigerian President at Lambert Palace, London, and had also paid a goodwill visit to President Buhari in March this year, during his medical vacation. [myad]
