Senate And Sagay’s Ribaldry, By Sufuyan Ojeifo

On Wednesday, March 29, 2017, the senate, in plenary, reacted to the verbal offensives by the chairman of the Presidential Advisory Committee Against Corruption (PACAC), Professor Itse Sagay (SAN), who was quoted to have said that the upper legislative chamber is “filled with people of questionable characters who put personal interest ahead of the nation.”

Sagay had also, in the same context, referred to senators as “childish and irresponsible” for rejecting the nomination of Mr Ibrahim Magu as substantive chairman of the Economic and Financial Crimes Commission (EFCC) and asking President Muhammadu Buhari to sack Magu from office within two weeks from Tuesday, March 28, 2017, following his rejection for the second time, as a condition to screen his (Buhari’s) 27 Resident Electoral Commissioner nominees.

Had Sagay been a private citizen, he would have gone away with the blue murder of denouncement, elegantly dressed in the garb of criticism.  But to be sure, Sagay holds a key appointment in the federal government.  Against this backdrop, therefore, the senate has refused to dismiss Sagay’s outlandish comments as mere criticism or expression of opinion.

The comments, made in his capacity as chairman of PACAC, remain weighty on the scale of perception and impression.  The perceptual process of decoding Sagay’s lines with the common errors of distortion has created the negative impression that the hands of some senators must have been caught in the cookie jars of crime; otherwise, he would not have come out smoking against the institution of the senate and its occupants in the manner he did.

Sagay, arguably, targeted the collective integrity of the senate, did incalculable damage to it and provoked a legislative rage that resulted in the issuance of a summons on him to appear before its committee on ethics and privileges to distinguish among members those with questionable characters.  The senate would want Sagay to be precise in his onslaught instead of relishing his cheap and jejune attempt at class or institutional damage.

It is not in doubt that Sagay is an unabashed supporter of Magu. He decided to play to the gallery with his ribaldry against the senate to rubbish its decision on Magu and the call for his sack.  I believe that the senate would have ignored Sagay just as it has done to another human rights activist and critic, Femi Falana (SAN), were he not occupying a strategic position in this government.  On that basis, Sagay’s extremely emotional and partisan outburst becomes somewhat uncharitable.

The outburst also portrays the otherwise prudent legal luminary as bereft of discretion, which is a virtue in legal practice and public administration.  I am, however, at great pains to go away with that impression.  But if I were Sagay, I would not have become a loose cannon within a government in which I am a member.  I would have exercised self-restraint. The way his action has played out has made him a partisan supporter of an agency of a branch of government against another branch of government.

Sagay’s activism thus becomes questionable on that plank.  He cannot then reasonably proceed to seek protection in non-conformism to react, condescendingly, to senate directive to him to appear before it.  I consider his declaration that the senate summons on him is illegal as impulsive.  It is an act of legal bullying.  He has, by that act, only aggravated the already frosty relationship between the executive and legislative arms of government.

If I were Sagay, rather than shun the senate and wait for its resolution calling on the president to sack me, I would seize the big stage by quickly announcing my resignation.  I would flaunt it in the faces of senators that I am more honourable than they are.  I would declare that I have nothing personal to lose by resigning but that the nation stands to suffer greater integrity deficit by allowing some “questionable characters” to come to equity with dirty hands.

I would heap on the senate a moral burden that will be too heavy for it to bear.  This is a great opportunity for Sagay to make an eternal statement in the ecology of public administration in Nigeria.  Instead of swiftly accepting the invitation, he had declared magisterially that his invitation to appear before the senate committee is illegal by the combined reading of the provisions of sections 82 to 89 of the Constitution of the Federal Republic of Nigeria 1999, as amended.

Sagay’s contention is that the sections limit the senate powers because he is far outside the category of people it can ever invite.  I disagree with the learned silk.  He is an appointee of the federal government; and, to that extent, he is an agent of a disclosed principal- president- whose actions and powers, including delegated powers, are subject to judicial, legislative and even executive reviews.  He is thus answerable to the summons of the senate.  He is arguably caught by the provisions of Section 89.

But this is not the time to prove knowledge of the law to engage in an enduring face-off with the senate.  It is unnecessary. He has nothing more to prove.  He is an accomplished legal titan.  He should therefore not make the mistake, at this intersection in his life as a septuagenarian, to sink deeper into the morass of activism by shunning an opportunity to speak truth to legislative power.  He should appear before the committee and meet minds with members on how to come to equity with clean hands.

If I were him, since I did not mention the name of any individual member, I would go there, insist on my earlier position, refrain and refuse to mention any name, even at the point of bayonet.  But good enough, this is democracy.  The senate does not have the coercive power to bring words out of the mouth.  Even in a military junta, an individual can dare dictatorship and pay the supreme sacrifice in the process.  That is the mark of courage.

Sagay should be strengthened by the courage of his conviction.  He should appear before the senate with his moral and anti-corruption armoury to constructively engage legislative power without necessarily mentioning names of senators with questionable characters.  That should be left for the anti-graft agencies to do, consequent upon thorough and conclusive investigations.

In essence, he would have honoured the senate invitation and soothed frayed nerves.  He would also have used the opportunity to guide the senate on the impropriety (in case he is correct) of such invitation to him or another person(s) in the future.  He would have, thus,  added value to the legislative process.

But if Sagay still wants to stir the hornet’s nest and decides to act true to type as an activist by going there to mention names, he would have succeeded in distinguishing the good senators from the questionable ones.  His courage would be applauded.  Those senators who are not mentioned will hold their heads high.  The only thing that can happen would be for the senators mentioned to head to court to prove that they are people of integrity.

Is this what Sagay wants?  Should he not rather allow the advisories in the official report of his committee to dictate the trajectory of the anti-corruption measures to be taken in the light of the committee’s findings?  These should be the issues for contemplation, and not the needless muscle-flexing and shouting game between him and the senate.

Boko Haram Still Have Sympathizers Collaborators, Chief Of Army Staff Swears

The Chief of Army Staff, Lt.-General Tukur Yusuf Buratai has said that Boko Haram still have some sympathizers and collaborators amongst the people in the locality, especially in the North East where the terrorism hold sway.

Speaking in an interview today, Sunday with the News Agency of Nigeria (NAN),  the Chief of Army Staff appealed to Borno people to expose the collaborators and indeed, the perpetrators of the dastardly and inhuman act of the Boko Haram.

“Definitely, there is no way you will say that these suicide bombers, who are teenagers, young girls, some even under-age can move in from wherever they are strapped into the town except with the guidance of someone within the town or vicinity.

“We still suspect that there are some sympathisers and collaborators or some members that have sneaked into town hiding and they direct these would-be suicide bombers to targeted areas.

“The issue of suicide bombing is an issue of intelligence which we are working in collaboration with other security agencies and indeed with the civil authority to see how this can be addressed quickly.”

General Buratai said that the “key area” from where the insurgents have been launching suicide bombing has been cleared by troops in conjunction with other security agencies, saying that this has reduced the incidents of suicide bombings in the last couple of days in Borno, particularly Maiduguri.

“By and large, I tell you it – suicide bombing has been reduced drastically. In the last three days, there has been no Improvised Explosive Devices (IEDs) attack or suicide attacks and this, we hope it will continue.

“They may decide to come but we are able to take out one key area that we are even suspecting, our troops were able to clear them in conjunction with other security agencies.

“I won’t say at this stage that we have been able to make breakthroughs in respect of suicide bombing, but we have made substantial progress and we hope it will be sustained,’’ Buratai said.

He said that suicide bombing must be stopped once and for all even as he said that having won the war, there is the need to also win the peace.

He said that this required the collaboration of the military, other security agencies and the people.

Panic As Lassa Fever Surfaces In Kogi

There is some measures of uncertainty in Kogi as a case of Lassa fever was today, Sunday, confirmed at the Accident and Emergency Unit of the Federal Medical Centre, Lokoja the State Capital, involving a male patient who resides at Angwan Kura, Lokoja.

Report reaching us from Lokoja said that the patient, after undergoing some analysis as a result of symptoms suggestive of haemorrhagic fever, was found to be infected with the fever.

“The State Epidemiologists immediately responded by sending the patient’s blood sample to the designated Laboratory at Federal Specialist Hospital Irrua, Edo State for analysis, which came back positive for Lasser fever. The patient was eventually transferred to Federal Specialist Hospital Irrua, Edo State for optimal care.”

Based on the report, the report said, the state commissioner for Health Dr. Saka Haruna Audu summoned the State Rapid Response Team during which provisions were made for source/contact tracing and prophylactic treatment for medical personnel who had contact with the patient before transfer, adding that all those who have had contact with the patient are currently being closely monitored.

“It is important to note that it was discovered that the patient had travelled to Illorin, Kwara State where he had stayed for two weeks. He only developed symptoms of haemorrhagic fever two days after his return. We are therefore uncertain whether he contracted the virus there or here in Lokoja.

The commissioner appealed to the people of the state to rise up in unison to prevent further spread of the disease, saying that now, jingles and other means of public enlightenment are ongoing.

A statement by the special adviser to the President on media and publicity, Femi Adesina, quoted Buhari as also describing Obey as multi-talented entertainer and gospel music maestro.

President Buhari said: “please, accept my congratulations, and that of teeming Nigerians, on this occasion of your 75th birthday anniversary.

The Management of  Newsdiary Communications Limited,  publishers of Newsdiaryonline has announced that  the online newspaper has resumed publication again after it experienced what it called “malicious cyber attack” last Thursday.

A statement by the Publisher and Editor-in-Chief, Mr Danlami Nmodu, described the attack as worst the company had suffered since 2008 when it started publishing Newsdiaryonline.

The publisher, who expressed gratitude to Almighty God and the wizardry of the company’s IT professional, also thanked those who expressed sympathy, solidarity with and encouraged the management through social media platforms.

Danlami would not understand where the where the attack came from but said: “we are however, convinced that evil cannot triumph over good. With Saraki In Charge, Present Senate Is Morally Bankrupt, Falana Rules

A Lagos human rights lawyer, Femi Falana has described the current senate, headed by Dr. Bukola Saraki as morally bankrupt and that because of moral question, it is now exercising power beyond its constitutional limit.

Falana who spoke in an interview on Channel TV, insisted that the current senate cannot screen the leadership of anti-graft agency such as Economic and Financial Crime Commission (EFCC), even as he said that the rejection of Ibrahim Magu and subsequent calling for his replacement as the EFCC acting chairman was the highest of impunity.

Falana said that section 171 of the Nigerian constitution vested exclusive power in the President to appoint any person to hold certain office or act in that capacity, explaining that the constitution allows the President to appoint secretary to the government of the federation, permanent secretaries, heads of service, and heads of extra ministerial department such as EFCC without the confirmation of the Senate.

He added that the only exception is the appointment of ambassadors or headsh of foreign mission, saying that the presidency is ill advised for sending name of the EFCC’s boss to the Senate for confirmation in the first place because there is no constitutional provision that compels such action.

According to the human rights lawyer, section 2(3) of the EFCC act which the executive tries to fulfill is superseded by section 171 of the constitution.

He advised the lawmakers to seek the amendment of the constitution if they must remove such constitutional power of the President because as the law currently stands “refusing to confirm the nomination of a public officer does not annul the acting capacity of such an officer.”

Falana said that senators who are standing trial or being investigated by EFCC should not have been part of the screening exercise conducted for Magu because of their conflict of interests.

“This senate will not have approved the nomination of Magu because not less than 15 members are either standing trial or they are under investigation for corrupt practice. The fact that you are standing a trial or under investigation means you cannot sit.”

Falana said the senate headed by Saraki could not have confirmed Magu, adding: “the senate President, Dr. Bukola Sataki ensured that Mallam Nuhu Ribadu was removed when he was to be charged over the   collapse of Societe Generale Bank. Lamode was removed when he invited the wife of the Senate President, Dr. Bukola Saraki.  Magu could not have been confirmed because EFCC is investigating the allegation that  $3.5 billion from Paris-London loan refund has been traced to his account. How could the house headed by such a man confirm Magu?” [myad]

Bureau De Change Boss Accuses Some Banks Of Refusing To Sell Forex

The President, Association of Bureau De Change Operators of Nigeria (ABCON), Alhaji Aminu Gwadabe, has accused some banks for refusing to sell dollars for the invisibles, such as personal and business travel allowances thereby complicating the position of the local currency despite the efforts of the Central Bank of Nigeria in flooding the market with dollars.

In an interview with the News Agency of Nigeria (NAN) today, Saturday, in Lagos, Aminu Gwadabe supported the recent directive by the CBN, asking members of the business community to report any bank which is into sharp practice, for necessary sanction.

He said that it is an ironoy that the naira started losing strength in spite of the CBN’s review of the rates from N375 to N360 to a dollar, adding that the naira started trading on Monday with a promising outlook for sustained strength against the dollar and other currencies, “but it began to somersault at the middle of the week.

“The naira ended deeper northward to close at N394 to a dollar on Friday, translating to 10 per cent depreciation of what was recorded during the week.”

Aminu Gwadabe said that the removal of disparity in applicable exchange rates among the BDCs, Travelex and the banks should have strengthened the nation’s currency.

“CBN’s knack for last minute solution as recent development has shown, accounted for the misfortune of the naira at the foreign exchange market.”

Aminu Gwadabe said that the battle for the soul of the naira would be won if the CBN could boost liquidity to the BDCs for effective unification of rates.

“It is evident that the injection of liquidity to the interbank market rather than the BDC sub-sector is not effective and transparent for sustained FOREX rate convergence and unification.

“Statistics from the CBN shows that about 20 banks get 80 million dollars weekly for invisible transaction as against the 20 million dollars weekly for over 3000 CBN licensed BDCs nationwide.

“The CBN should enhance public awareness to guide end users on FOREX availability and applicable exchange rates.

“The CBN should diversify the buffers from oil proceeds to foreign investors inflows and Diaspora remittances.”

He advised the CBN to sponsor a bill for an act of the National Assembly for naira convertibility in West Africa, as part of the solutions to full recovery of the naira, saying that naira is currently a means of exchange in about 15 countries in Africa.

He called on the Federal Government to increase security surveillance at the nation’s airports and land borders to checkmate illegal foreign cash evacuation.

“Similarly, one Bulama Kailani Mohammed Metele from Tumbun Bera, a confessed Boko Haram terrorist belonging to Mamman Nur’s faction of the terrorists group under the leadership of Abu Mustapha, apparently tired of the lies his commanders, surrendered himself to troops of 145 Task Force Battalion, 5 Brigade, troops at Damasak.

“It has been confirmed that the surrendered suspect, Bulama Kailani Mohammed Metel, was a high profile terrorist as he is at Serial number 253 on the Nigerian Army’s Wanted Boko Haram terrorists poster produced recently. He is currently undergoing further interrogation.”

Also, the Army spokesman said that troops of 158 Task Force Battalion of 5 Brigade in Maiduguri have arrested two suspected Boko Haram terrorists carrying out surveillance on Kareto and Dangalti villages following reliable tip-off.

He said that preliminary investigation showed that the arrested spies were on research mission to facilitate possible Boko Haram attack on the communities.

“On Tuesday, 28th March 2017 at about 10.00am based on information 2 suspected Boko Haram terrorists carrying out surveillance on Kareto and Dangalti villages were apprehended by troops of 158 Task Force Battalion of 5 Brigade, Nigerian Army.

“Preliminary investigation shows that the apprehended spies were on reconnaissance mission to facilitate possible attack on the communities by Boko Haram terrorists.” [myad]

Court Sacks President Of Nigeria Bar Association, Voids 2015 Constitution

A federal high court in Abuja has sacked the President of of the Nigeria Bar Association (NBA), Abubakar Mahmoud after rendering void, the 2015 constitution under which he was elected in July last year.

The court quietly removed the President from office after listening to a suit filed by Supo Ojo, a lawyer, challenging the procedure of amending the constitution of the NBA.

The court ruled that Mahmoud emerged President of the NBA on the voided constitution, adding that by implication, his recommendation of senior lawyers to the National Judicial Council (NJC), for appointment as judges is now invalid.

Meanwhile, the general counsel of the NBA is expected to take over as President of the association until a fresh election is conducted under the constitution passed by a resolution of members in 2001.

Abubakar Mahmoud, former Kano State attorney general and commissioner for justice, was elected as the President of the NBA on Monday, August 1, 2016 where he got 3,055 votes to defeat Joe-Kyari Gadzama who polled 2,384 votes. [myad]
