We’re Going To Make Abuja Very Hot For Kidnappers, Bandits, Minister Wike Vows

Minister of the Federal Capital Territory (FCT), Nyeson Wike has made it clear that the government is set to make Abuja very hot for kidnappers, bandits and other criminals that have recently invaded parts of the city.
“To all those criminals and bandits, enough is enough. We will do everything within our powers to make sure that we do not allow this to happen again.”
Speaking today, January 17, in Bwari, at a townhall meeting with relevant stakeholders, the minister said that the bandits terrorizing the residents of the FCT are those who were dislodged from the North East and are making inroads into the nation’s capital.
He vowed that his Administration will make the city very hot for them, even as he solicited the support of the traditional institutions and community leaders.
He advised them to provide information to the security agencies for timely and proactive actions.
“Everybody has a role to play by providing information. By information, you help the security agencies to proactively take control before anything will happen. What will solve the problem is your support to the security agencies.”
The Minister said that he has been mandated by President Bola Tinubu to work with the Service Chiefs to ensure that security challenges are brought to a halt.
Wike announced that approval has been granted to provide all that are required by the security agencies to address security threats in Bwari Area Council and other parts of the FCT.
“Just this morning, Mr. President has given me approval to provide every logistic required to the security agencies. This is not just mere talking. We are serious.
“Security agencies will not have any reason to say that they are not equipped. We will provide everything required.”
He said that the security agencies will take proactive actions in the coming days to bring kidnappings to halt, adding that the government is also doing everything possible to ensure the release of the kidnapped victims.
He assured the Chairman of the area council that vehicles and other logistics support would be provided for the security agencies and other security outfits to encourage them in their efforts.
The Minister who sympathised with the victims of the kidnap incidents and the loss of lives, cautioned residents against disclosing their intentions to raise funds for ransom.
He said that such actions is helping the bandits and not the government or the people
“Stop going to make announcements that you are ready to raise money. By going to the radio stations, you are not helping us. You are helping them.
“Why would I go and give a criminal N100 million. There is no money to be raised anywhere. We will fight them to release our people. We will chase them away.”

Court Cripples Broadcasting Commission’s Power To Impose Fines

A Federal High Court in Abuja has declared null and void, the provisions of the Nigeria Broadcasting Code, authorizing the National Broadcasting Commission (NBC) to impose fines on broadcast stations for alleged breaches of the Code.
The court ruled that administrative and regulatory bodies cannot exercise judicial powers.
The judgment was delivered today , January 17, in a suit instituted by Media Rights Agenda (MRA) against the NBC, following the Commission’s imposition of fines of N5 million each on a television station and three pay TV platforms in 2022. They were alleged to have undermined Nigeria’s national security by broadcasting documentaries on banditry in Nigeria.
Justice Rita Ofili-Ajumogobia, in the judgement, held that the NBC, not being a court of law, acted above its powers by imposing such fines.
The judge commended MRA for challenging the NBC’s action even as it issued an order of perpetual injunction restraining the Commission or anyone acting on its behalf, from further imposing any fine on any media platform or broadcast station in Nigeria for any alleged offence committed under the Nigeria Broadcasting Code.
Justice Ofili-Ajumogobia set aside the fines imposed by the NBC on August 3, 2022 on Multichoice Nigeria Limited, owners of DSTV; TelCom Satellite Limited (TSTV); Trust-TV Network Limited and NTA Startimes Limited for broadcasting a documentary about the state of banditry and security in Zamfara State.
He stressed that the regulator’s action was wrong and unjustifiable in a democratic society.
The Abuja-based human rights lawyer, Uche Amulu, filed the suit on behalf of MRA, asking the court to hold, among other things, the NBC’s action of imposing a fine on each of the media platforms and the station for broadcasting a documentary about the state of banditry and security in Zamfara State is unlawful and unconstitutional and has a chilling effect on the freedom of media to impart information and ideas.
MRA contended that it would deter the platforms and station from reporting the true state of affairs regarding the security situation in Nigeria, and therefore constitutes a violation of the rights of MRA, its members and other citizens of Nigeria to freedom of expression, particularly their rights to receive ideas and information without interference, as guaranteed by the Constitution and the African Charter on Human and People’s Rights.
MRA also sought a declaration that the procedure adopted by the NBC in imposing the fines is a flagrant violation of the rules of natural justice and the right to fair hearing under Section 36 of the Constitution and Article 7 of the African Charter as the Commission is the drafter of the Code, which provides for the alleged offences for which the media platforms and the station were punished, and which empowers the NBC to receive complaints, investigate and adjudicate on the complaints, impose fines and collect fines.
MRA contended that the NBC, not being a court of law and not having been constituted in a manner as to secure its independence and impartiality, has no power or competence to impose fines on broadcast stations as punishment or penalties for the commission of an offence as the competence to establish that an offence has been committed and to impose criminal sanctions or penalties belongs to the courts.
It said that the NBC, not being the Nigerian Police or a law enforcement agency, has no power to conduct a criminal investigation or an investigation that could lead to criminal charges against the affected media platforms and stations or the imposition of criminal penalties and accordingly, that the investigation purportedly conducted by the Commission, leading to the fines imposed on the media platforms and station for alleged offences under the Nigeria Broadcasting Code is ultra vires, null and void.
MRA also urged the Court to declare that the Nigeria Broadcasting Code issued by the NBC, being a subsidiary legislation that empowers it as a regulatory and administrative body to enforce the provisions of the Code, cannot confer judicial powers or jurisdiction in criminal matters on the Commission to impose criminal sanctions or penalties such as fines, particularly as the Code was made by the NBC itself.
It urged the Court to declare the fines unconstitutional, ultra vires, null and void, set them aside and issue an order of perpetual injunction restraining the NBC, its servants, agents, privies, representatives or anyone acting for or on its behalf, from further imposing any fine on any of the media platforms or station, or any other broadcast station in Nigeria for any alleged offence committed under the Nigeria Broadcasting Code.
In her judgment, Justice Ofili-Ajumogobia agreed with all MRA’s arguments and granted all the declarations and injunction sought by the organization.
She however, refused to grant the organization’s claim for N700,000 as costs it incurred in litigating the action; another claim for N2 million as general damages for NBC’s infringement on its rights as well as a request for N1 million as punitive damages for the Commission’s “outrageous conduct in abusing its powers and arbitrarily imposing fines on broadcasting stations.”

BREAKING: U.S To Repatriate $8.9 Million Looted Under Ex President Jonathan To Nigeria

Goodluck Jonathan

A Royal Court in Jersey, United States, has reportedly ruled that stolen assets worth £6.9m ($8.9m) should be repatriated to Nigeria.
The said assets were allegedly diverted by Nigerian government officials in 2014 under the guise of purchasing arms to fight Boko Haram terrorists.
According to BBC, the court ruled that the money, deposited in a Jersey bank account, was likely stolen by officials in the Nigerian Government in 2014.
The order of the Royal Court in Jersey followed a forfeiture notice to the court by Jersey’s Attorney General, Mark Temple KC.
The court held that the funds were deposited in a Jersey bank account and were not used for the arms purchase.
Temple said that the Government of Jersey was in close partnership with Nigeria on the repatriation of the funds.
The AG claimed that part of the funds were shared with family members of politicians in the then-ruling Peoples Democratic Party (PDP) ahead of the 2015 general election.
“This case again demonstrates the effectiveness of the 2018 Forfeiture Law in recovering the proceeds of corruption and restoring that money to victims of crime.
“I now intend to negotiate an asset return agreement with the Federal Republic of Nigeria,” he said.
Controversies had surrounded the purchase of weapons in the fight against Boko Haram insurgence with the then National Security Adviser, Sambo Dasuki, being accused of diverting funds meant for security equipment during Jonathan’s administration.
Also in late 2014, a private jet was arrested in South Africa with $10 million cash, which was allegedly meant for the purchase of military weapons.

“We will do all we can and we assure Nigerians who reside here that there is no need for panic. We are taking every step to make sure that those challenges are things that we must have to resolve.
“So, this meeting is practically to look into such challenges and see how we will be able to resolve the problems and that’s why we invited all the council chairmen because they also have a responsibility in their various Area Councils. “So, we will put our heads together and come up with solutions.”
