Student Drags Baze University To Court, Demands N20 Million Damages

A student of Baze University, a private institution in Abuja, Leo Ekpenyong has filed a suit in the Federal Capital Territory High Court, Maitama, over the refusal of the institution to review his 2019 trimester results.

Ekpenyong, a Masters student of the Mass Communications Department of the university filed the suit through his counsel, Yakubu Philemon and is claiming general damages in the sum of N20 million for all the psychological trauma caused by the refusal of the university to review his 19A trimester results in Msc 801, theories of Mass Communications and Msc 803 of Research Methodology.

In an originating summons filed in the court, the applicant’s counsel, Philemon said that the defendant’s refusal to accede to the applicant’s request for review of his 19A results of Msc 801 and Msc 803 “is a breach of the Students Handbook of 2011”.

Philemon said that the institution’s refusal to review the results is against the provision of paragraph 2.9 of the Baze University’s Handbook and right to fair hearing under Section 36 of the 1999 Constitution.

According to the summons, by virtue of the provisions of paragraph 2.9 of Baze University Abuja Policy, Procedures and Regulations, the defendant is bound to arrange and convene an Academic Appeal Panel to look into the applicant’s complaint.

“An order compelling or directing the defendant to arrange and convene an academic appeal panel in respect of the complaint by the applicant on 19A trimester result in Msc 801, theories of Mass comm and Msc 803, Research Methodolgy.

“An order of this honourable Court, directing the defendant to set up an independent panel of examiners as a globally acceptable practice, in accordance with paragraph 26 of the Baze University Abuja Policies and Procedure in the students handbook of 2011.

“Whether the defendant’s Academic Appeal Panel will not be biased in its arbitration, taking into consideration the refusal of the defendant to respect and abide by the provisions of paragraph 2.9 of the handbook of Baze University, Abuja,” the summons said.

It will be recalled that the claimant, a First Class graduate of Mass Communications had explored all available internal remedies within the university to settle this issue including a petition to the National University Commission to no avail.

This prompted him to seek redress at the law court.

Meanwhile, the suit is yet to be assigned to a judge on the issue.

Presidency To Punch: If You Don’t Understand English Write In Your Mother Tongue

Femi Adesina

The Presidency is angry with the Punch newspaper for what it called a twisted story with malicious intent in Saturday Punch of September 14, 2019, with the front page headline: “Tribunal: Buhari retracts, confesses he was under tension.”

In a statement today, September 14, reacting vehemently to the story, special adviser to President Muhammadu Buhari on media and publicity, Femi Adesina said that the newspaper showed simple lack of understanding of the English language which the President used when he received the governors of the All Progressives Congress (APC) extract at the Presidential Villa, Abuja yesterday.

An angry spokesman told the Punch reporter and the editor to opt for their mother tongue in writing their news items if they have challenge with English language.

“If the Punch reporter and the editor (if he, indeed approved the mischievous story for publication) had so much challenge with the English language, they could have opted to write in their mother tongue. It could have served them better.”

Femi Adesina said that President Buhari specifically referred to judgment day by the tribunal, which coincided with the maiden meeting of the Federal Executive Council (FEC), adding that President Buhari had said: “It was a fabulous coincidence that it came almost the same time the first FEC meeting of this government was taking place.

“It lasted about the same time with the judgment. I thank God for that because I think I would have gone into trauma or something. So, I was busy trying to concentrate on the memos.”

The Presidential spokesman said that an elementary understanding of the English language shows that President Buhari was talking specifically of the day and time of the court ruling, not before.

“Saturday Punch went further to say that the President’s remarks amounted to a retraction of his earlier statement, in which he said he had been unperturbed about the judicial challenge to his electoral victory.

“Hear the statement personally approved earlier on Wednesday by the President: “Good conscience fears no evil report. I was unperturbed all along because I knew Nigerians freely gave us the mandate. We are now vindicated.”

“I was unperturbed all along… Was that referring to judgment day? A simple comprehension of English language indicates otherwise. It referred to the many months the case lasted in court.

“To further show malice and evil intent, the newspaper indicated that the President may not have been privy to the earlier statement that emanated from his media office. Who does that, for such a landmark development, without the consent of the principal? As a piece of information, the President personally approved the statement for release, as the FEC meeting was winding to a close. If stories end up being dumped in Saturday Punch without the editor approving it, then the newspaper should not use such pedestrian standard in judging the media office of the President.”

Buhari Looks Beyond His Second Tenure, Asks Leaders To Position APC For The Future

President Muhammadu Buhari has stressed the need for leaders and governors on the platform of the ruling All Progressives Congress (APC) to invest more into positioning the party for the future.

“We really need to institutionalize the party so that when we leave, the party will continue to lead.”

The President spoke today, September 13, when the APC leaders and Progressives Governors’ Forum, paid him congratulatory visit at the Presidential Villa, Abuja, on the outcome of the judgment of the Presidential Election Tribunal which affirmed his re-election in the February 23, 2019 election.

President Buhari said the victory at the tribunal was collective as it affects all the party members, governors and Nigerians, pointing out that a contrary judgment would also have affected all members of the party.

Buhari said that he joined the military immediately after secondary school and that the reality of discipline carried through his years of serving the country, including fighting in the war front.

This was even as the Chairman of the APC, Comrade Adams Oshiomhole said that the judgment was eloquently and analytically delivered to clear all doubts on the veracity of the President’s school credentials, assuring him of the party’s loyalty and support.

“We never had any doubt. We were convinced of our victory. It is of particular interest that the only asset that the President has invested and continues to invest is his integrity. And we saw some people trying to throw mud at that integrity. On personal integrity, the opposition party does not have in their rank any man or woman who has your integrity.’’

The Chairman of the Progressive Governors’ Forum, Alhaji Abubakar Atiku Bagudu, Governor of Kebbi State, congratulated President Buhari on the victory at the tribunal, noting that his dedication to duty and serving the country kept him at FEC meeting at the crucial moment.

Describing the judgment as clinical, with surgical precision in dealing with all the issues raised, Governor Bagudu assured the President of the support of all APC governors, and other governors that had benefited from his leadership.

The Rivers State Governor, Nyeson Wike has warned the party on which platform he is ruling the State, the Peoples Democratic Party (PDP) not to toy with the interest of the state.

“We are warning PDP to be careful not to toy with Rivers State. The state has all it takes to withstand the PDP and fight the party to a standstill. Rivers governor is not one of those governors that anyone can cajole. He is not one of those governors that will kowtow to illicit activities.”

Governor Wike’s attack of his PDP came on the heels of a committee set up by the party to investigate Ndudi Elumelu’s emergence as the minority leader of the House of Representatives.

“The committee set up by the PDP on the illegal emergence of Ndudi Elumelu is the most corrupt committee ever set up by the party. We thank our worthy son, Austin Opara, for withdrawing from that committee, so that he is not entangled in the illegal activities of the tainted committee.”

Wike further warned: “nobody should dare Rivers State any longer. Enough is enough. PDP should know that we are not a punching bag. We are not a people you can use and push. We are not harlots. Whenever you want, you come. When you finish, you push us aside.”
